Sec. 2-2. Zoning
district map; flood boundary and floodway map; airport district
map.
2-2.1. Establishment
of official zoning district map. The locations and the
boundaries of the zoning districts, other than Floodplain
Districts and the Lonesome Pine Airport District, established
by this Ordinance shall be shown on a map or series of maps
designated as the "Official Zoning District Map of
Wise County, Virginia" which, together with all notations
and explanatory matter shown thereon, is hereby made a part
of this Ordinance. Said map shall be dated, endorsed with
the signature of the county clerk and maintained for public
view in the office of the county clerk. The official zoning
district map shall not be removed from the office of the
county clerk, except by court order or for such official
purposes as may be directed by the county administrator.
2-2.2. Flood
boundary and floodway map. The locations and boundaries
of the Floodplain Districts shall be as described in the
Wise County Flood Protection Ordinance and shown on the
flood boundary and floodway map prepared by the Federal
Emergency Management Agency, which ordinance and map are
hereby made a part of this Ordinance.
2-2.3. Airport
district map. The locations and boundaries of the Lonesome
Pine Airport District shall be as described in the Wise
County Lonesome Pine Airport Zoning Ordinance and shown
on the official map accompanying said ordinance, which ordinance
and map are hereby made a part of this Ordinance.
2-2.4. Changes
on district map. It shall be unlawful for any person
to make changes on the official zoning district map except
by authorization of the zoning administrator in accordance
with the provisions of this article.
2-2.5. Copies
of district map. The zoning administrator shall cause
copies of the official zoning district map to be made in
such numbers and in such form as deemed appropriate by the
board of supervisors. In the case of any differences or
discrepancies between the official zoning district map and
any copies thereof, the official zoning district map shall
be the final authority as to the current zoning classification
of property in the county.
2-2.6. Amendment
of district map. Whenever an amendment is made to the
official zoning district map by ordinance adopted by the
board of supervisors, the zoning administrator shall see
that the amendment is properly recorded on the map together
with such notation or reference as is necessary to identify
the action by which the amendment was made and the date
thereof. Each amendment shall be recorded on the official
zoning district map as soon as practicable after the effective
date of the amendment. The failure to record any amendment
on the official zoning district map, or any error in recording
or depicting an amendment thereon, shall not affect the
validity of the ordinance providing for the amendment.
Sec. 2-3. Interpretation of district
boundaries.
Whenever uncertainty
exists with respect to the boundaries of any of the districts
as shown on the official zoning district map, the following
rules shall apply:

Where a discrepancy
exists between a district boundary shown on the official
zoning district map and that which is described in the
text of the ordinance establishing such boundary, the
text of the ordinance shall govern.

(Where district boundaries
are shown with specific dimensions from streets or other
physical features, such dimensions shall govern.

Where district boundaries
are indicated so as to approximately follow the centerlines
of streets, highways, alleys or railroad lines, such
boundaries shall be construed as following such centerlines.

Where district boundaries
are indicated in such a manner that they appear to follow
street, lot, property or corporation lines, such boundaries
shall be construed as following such lines. The location
of any street, lot, property or corporation line used
as a district boundary shall be the location in existence
at the time of the adoption of the ordinance establishing
the boundary.

Where district boundaries
are so indicated that they appear parallel to, perpendicular
to, or as extensions of centerlines, property lines
or other features, they shall be so construed.

Where district boundaries
are so indicated that they appear to follow shorelines
of rivers, creeks or other bodies of water, such boundaries
shall be construed to follow such shorelines at mean
low water. In the event of natural change in a shoreline,
the boundary shall be construed as moving with the actual
shoreline. Boundaries indicated as following the approximate
centerlines of bodies of water shall be so construed.

Where district boundaries
are not described in any ordinance and do not appear
to follow any centerlines, street lines, property lines
or other features, the location of such district boundaries
shall be determined by measurement on the official zoning
district map in accordance with the scale shown thereon.

In any case where none
of the foregoing rules establish the location of a district
boundary, or where subsequent dispute or uncertainty
exists, the location of such district boundary shall
be determined by the board of zoning appeals in accordance
with the provisions of Article 9 of this Ordinance.
