Board of Supervisors - March 22, 2017 Recessed Meeting

The Wise County Board of Supervisors met in a Recessed Meeting on Wednesday, March 22, 2017 @ 5:00 PM at the School Board Education Center located on 628 Lake Street in Wise.  The following members were present:

AGENDA

A motion was made by Ronnie Shortt, seconded by Bob Adkins, to approve the agenda as presented to include items in red.  The motion was unanimously approved.

IN RE:  RESOLUTION  ECONOMIC DEVELOPMENT REGIONAL/JOINT AUTHORITY

Attorney Mullins explained that this resolution is a working document to bring localities within far Southwest Virginia, as a cooperative group,  to develop a strategy for possible revenue sharing and cost sharing for projects of mutual economic development interests.

Ms. Kilgore asked if this resolution would create any legal obligation for the County.

Attorney Mullins stated that it only declares the intent to work together.

Supervisor Rivers voiced his concerns with adopting this resolution.  He noted that Wise County IDA is the one bringing in jobs and moving forward, and that’s why other counties want to join with Wise County.  The resolution does not give details on revenue and cost sharing, which is a major factor to be concerned about.  There must be funds available for some administrative staff, and none is mentioned.  He further questioned if the Cumberland Plateau is working toward a similar initiative.  Another concern was the impact this will have on the localities industrial development or economic development authorities.  He, however, is relieved to know that this joint effort is not legally binding.  He also understands that the legislators are creating a new regional marketing authority using funds from VCEDA. 

He felt that “Go Virginia” would be the best route for Wise County.

After further discussion, a motion was made by Ronnie Shortt, seconded by Robby Robbins, to approve the resolution in support for establishing an Economic Development Regional or Joint Authority for the City of Norton, Lee, Scott, Wise and Dickenson Counties.   The motion was unanimously approved.

RESOLUTION # 14-2017

IN RE:  RESOLUTION IN OPPOSITION OF UTILITY RATE INCREASE

A motion was made by Fred Luntsford, seconded by Robby Robbins, to approve the resolution opposing the requested utility rate increase for Kentucky Utilities Company d/b/a Old Dominion Power Company.
The motion was unanimously approved.

RESOLUTION # 15-2017

IN RE:  RESOLUTION SETTYING PROPERTY TAX RATES

Finance Administrator Cox advised the Board that there is no tax increase for FY 2017-18.

A motion was made by Ronnie Shortt, seconded by Robby Robbins, to approve the resolution setting the property tax rates for FY 2017-2018.  The motion was unanimously approved.

RESOLUTION # 16-2017

IN RE:  DEMOLITION POLICY DISCUSSION

Attorney Mullins provided the Board with a handout on options for providing a Policy/Procedure for condemned or blighted properties.   At present, the County has a list of 34 condemned properties that have been on the books for 10 years or longer, which have delinquent taxes.  Most of these are residential properties  located in the County.   Some are partly burned and some are mobile homes.  There are also a few in the towns, which have their own property maintenance ordinance.  If the County gets involved in tearing down some of these buildings, additional insurance would be required, and money needs to be set aside to cover the cost for removal.  There is also the landfill fee to consider for disposing of the debris.  With the long list of condemned properties, the Board may want to consider removal by district.  The GIS Department would be available to provide mapping and do photos for Board members to review their districts.

Ms. Mullins explained the procedure that would be followed once a policy has been approved, and funding has been set aside to start the process.  She stated that she would have an updated ordinance for Board review prior to the April Meeting.  She suggested adding the proposed ordinance to the April agenda  to send out for a public hearing in May for public comments.

Board members voiced their concern for the need to remove these blighted / dangerous buildings, which has an impact on the environment, public safety, and the county’s endeavors to move forward.
IN RE:  CLOSE SESSION

A motion was made by Ronnie Shortt, seconded by Fred Luntsford, to go into close session as permitted by the Code of Virginia per the following Code Sections:

                Section 2.2-3711(A)(6)  Investing of public funds
                                                 (A)(7)  Consultation with legal counsel
                                                 (A)(1)  Personnel

Chuck Slemp and Greg Cross were invited into close session.

The motion was unanimously approved.

Following close session, a motion was made by Ronnie Shortt, seconded by Fred Luntsford, to reconvene the regular meeting.  The motion was unanimously approved.

IN RE:  RESOLUTION CLOSE SESSION CERTIFICATION

A motion was made by Fred Luntsford, seconded by J. H. Rivers, to approve the resolution certifying that only public business matters lawfully exempted from open meeting requirements as were identified in the motion convening the close session were discussed or heard by the Board of Supervisors.  The motion was unanimously approved by roll call vote.

RESOLUTION # 17- 2017

ADJOURN

A  motion was made by Fred Luntsford, seconded by Robby Robbins, to adjourn the meeting at 6:50 PM.  The motion was unanimously approved.
