Board of Supervisors - August 3, 2006 Workshop Meeting

The Wise County Board of Supervisors met in a Workshop meeting on Thursday, August 3, 2006 at 6:00 PM in the Board of Supervisors meeting room located in the Wise County courthouse.  The following was present:

PRAYER

Bob Adkins led in prayer.

PLEDGE

All led in the pledge of allegiance to the flag.

IN RE:  AGENDA ADDITIONS

It was the consensus of the Board to add the following item to the agenda:

  1. Closed Session 2.2-3711(A)(6) – Investment of public funds where competition or bargaining is involved

IN RE:  SOCIAL SERVICES DEPARTMENT – PRESENTATION

Michael Mullins, representing the Department of Social Services, provided an overview of the services provided by the Wise County Department of Social Services and the benefits offered to our citizens.  He provided an “Area Resource Guide” which provides addresses and phone numbers of organizations that provides assistance for those in need.

IN RE:  PUBLIC HEARING – CHANGE OF ZONING – SHELCY MULLINS JR

A public hearing was duly advertised for this date to receive citizens comments regarding a request from Shelcy Mullins, Jr. for a Change of Zoning on property located at 4909 Pole Bridge Road from a B-2 District to a M-1 District for the purpose of expanding his existing garage for repair and maintenance of his trucks.

There were no comments regarding this request.

There being no public comments, the public hearing was closed.

IN RE:  PUBLIC HEARING – CERTIFIED POLLUTION CONTROL EQUIPMENT AND FACILITIES EXEMPTION ORDINANCE

A public hearing was duly advertised for this date to receive citizens’ comments regarding a proposed Certified Pollution Control Equipment and Facilities Exemption Ordinance.

There was no one to speak regarding the proposed ordinance.

There being no public comments, the public hearing was closed.

IN RE:  PUBLIC EXPRESSION

Brad Stallard, Departmental Health Manager for the LENOWISCO Health District, briefed the Board on the purpose of the Pump and Haul Permit as it relates to the request from the Stone Mountain Pentecostal Church that is on the agenda for Board approval.  There were no questions from the Board regarding this permit.

Jimmy Wireman, a resident of 10012 Coeburn Mtn Road, asked that a guardrail be placed on Rellim Road on Rt. 688. 

Mr. Wireman told the Board that the Sheriff’s Department arrested his sister and had his brother in the vehicle with him.  He asked if deputies were allowed to haul private citizens around in their police cars and who would be liable if there was an accident and the person was killed or seriously injured.

Chairman Luntsford stated that public expression is for citizens to bring their needs before the Board and the Board would take notes and follow up requests that are made.

Walter Crouse addressed the Board as per the following list:

  1. Supports a leash law in Wise County because of the damage that the dogs do to gardens, destroys personal property, and depositing their waste in other people’s yards. 
  2. Supports a noise ordinance. 
  3. Asked that the Board take a leadership role in addressing improper mining laws and land that has been stripped should be reclaimed by planting trees. 
  4. Asked that people recycle more and do more research for using recyclable materials for manufacturing other products. 
  5. Asked that more enforcement be given to littering of the highways.

 
Donald Minor read to the Board a letter he had written and sent to the Coalfield regarding “Coal Haters” and their intent to silence the noise that is brought about with the machinery and the long hours that are needed to continue the coal mining operations.  He stated that perhaps they  need to boycott the benefits its brings to Wise County such as hospitals, grocery stores, schools, jobs of different sources associated with coal, and the list went on.  He ended his statement by saying that the more coal produced the less foreign oil we have to buy.

David Lawson, representing the Farm Bureau, voiced opposition to the proposed Noise Ordinance as it relates to the time schedule for the operation of machinery.  He said farmers must do their work late in the evenings and early morning because of the heat or working other jobs.  Consideration for the neighbors during late night work or early morning work is taken into prospective as much as possible.  Adopting an ordinance such as this would certainly place a burden on farmers as well a coal related jobs.

Chairman Luntsford stated that the Board has not entertained a public hearing on the Noise Ordinance at this point in time.   Citizens have only addressed the Board during public expression on this subject.

Hugh Kiser, a resident of Diggs Road in Esserville, spoke briefly on the Municipal City Sewer Sludge and the County ordinances that have been in place to prevent sewage sludge from being brought into our County.  It is his understanding that the County Ordinance against sludge may not be valid at this time.  If that be true, he asked that the sludge be regulated by an ordinance if it can not be prohibited.  He reminded the Board of the “Powell River Project” that brought so much controversy from the citizens of Wise County.  Mr. Kiser questioned whether or not any studies had been done on applying sludge to sloped land and if the sludge meets all of EPA’s regulations when it leaves the point of origin, and further how will one know it still meets EPA’s regulations at the point of destination.  He asked that our County not be a dumping ground for Municipal City Sewage Sludge since there seems to be no place for it to be dumped.  “Aren’t our children as good as the fish in the ocean”.

Starling Fleming , a farmer in Pound area, voiced his support of the sewage sludge because it is good for land cover and is more economical than fertilize.

Penny Bolling, a resident of the Pound area, representing concerned citizens of Wise and Dickenson counties who must cross over the bridges in Pound, stated that the conditions of a least two of the bridges located in Pound are dangerous and citizens must be assured that the bridges will be made safe for vehicles and pedestrians as soon as possible.  In addition to the safety of the bridges, the appearance is unacceptable.  This reflects an attitude of apathy and indifference.  The concern for the elderly walking the road has become a major safety hazard and visibility from the bridge is also a concern.

Mike Martin, employee of Paramont Coal, stated that the coal companies must have “shift” work for a profitable business.  These “shifts” provide jobs and promotes the economy.  Coal is the industry for our area and a means for providing for our families.  He asked that the Board consider all aspects of this proposed Noise Ordinance before any action is taken.

There being no further comments, the public expression period was closed.

IN RE:  ROADS AND HIGHWAYS

Highway Resident Engineer T. G. Branson said that work is being continued on Brown Street. Paving operations are underway throughout the County with Rt. 23 being resurfaced in the Pound area.

Regarding the bridge on Rt. 83, Mr. Branson stated that it was advertised at one time and the estimate was either to low or the bids came in to high and was rejected but was later re-advertised.  During that process of time, the bridge was converted to a federal funded bridge as are most of the present projects to utilize federal funding. This caused the project to be delayed.  Another estimate has been made on the bridge and is now ready to be re-advertised.  The bridge will be completely reconstructed with a sidewalk.

There was some discussion as to any options for safety measures until the bridge is in place.

Board members provided needs in their districts for VDOT review and response.

IN RE:  CONSENT AGENDA

The following items were reviewed:

  1. Set public hearing (6:00 PM – September 7) on six (6) E-911 road name additions
  2. Budget Amendments
  3. Resolution Behavioral Health Services Performance Contract

IN RE:  REVENUE SHARING AGREEMENT WITH RUSSELL COUNTY

Administrator Skinner noted that since Russell County needed access to Wise County’s share of the Virginia Coalfield Economic Development funding, it was agreed upon to enter into a revenue sharing agreement for Wise County to receive a 50% of tax revenues as a result of such agreement.  It was further requested to consider some type of permanent arrangement whereby Wise County would receive a share of funds beyond the 5-year life of the VCEDA loan.

At a meeting with Russell County’s Administrator and County Attorney, an agreement was negotiated whereby Wise County will receive 17% of “local tax revenues” after the first 5 years.

IN RE:  PUMP AND HAUL PERMIT – STONE MTN. PENTECOSTAL CHURCH

This Stone Mtn. Pentecostal Church applied for a Pump and Haul Permit for their church located on Stone Mountain.  The church was denied an on-site sewage disposal system and has therefore applied for a Pump and Haul Permit to serve the needs of the church.

IN RE:  APPOINTMENTS

The appointments were reviewed.

IN RE:  SESQUICENTENNIAL UPDATE

Shannon Scott and Bill Gobble gave the Board an update on the Sesquicentennial Anniversary Celebration to be held on Saturday, August 12.

IN RE:  ADMINISTRATOR’S REPORT

Administrator Skinner spoke briefly on :

  1. The status of the request from T. J. Barker regarding the re-naming of a portion of Rt. 58 “Veterans Memorial Highway”

BOARD COMMENTS

Board members voiced their appreciation to those working to assist during the RAM event.

ADJOURN

There being no further comments, the meeting adjourned at 7:30 PM.
