IN RE:  WAIVER OF NOTICE OF SPECIAL CALLED MEETING

The waiver of notice for the Special Called meeting was signed by all.

IN RE:  PURPOSE OF SPECIAL CALLED MEETING

Chairman Stallard stated that two Board members has requested this meeting for the purpose of going into Closed Session as permitted by section 2.2-3711A.7 of the Code of Virginia to discuss the Supreme Court ruling and pending lawsuits regarding landfill use fee.

IN RE:  CLOSED SESSION

A motion was made by Robby Robbins, seconded by Barry Nelson, to go into closed session as permitted by section 2.2-3711A.7 of the Code of Virginia to discuss the Supreme Court ruling and pending lawsuits regarding landfill use fee.  The motion was unanimously approved.

After a lengthy closed session, a motion was made by Bob Adkins, seconded by Virginia Meador, to reconvene the meeting.  The motion was unanimously approved.

IN RE:  RESOLUTION - CERTIFICATION OF CLOSED MEETING

Robby Robbins read the certification for closed meeting.

A motion was made by Robby Robbins, seconded by Bob Adkins, to adopt the resolution verifying matters discussed while in closed session.  The motion was unanimously approved by roll call vote.

IN RE:  LANDFILL USE FEE COURTCASE / RE-HEARING

A motion was made by Robby Robbins, seconded by Barry Nelson, to authorize counsel to proceed with filing for re-hearing on the landfill use fee lawsuits.  The motion was unanimously approved.

IN RE:  OTHER

A motion was made by Bob Adkins, seconded by Robby Robbins, to direct the County staff to collect information and draft ordinances to bring the landfill use fee ordinance in compliance with differences as stated by the Supreme Court for Board review at its November workshop.  The motion was unanimously approved.
