Board of Supervisors - November 7, 2002 Workshop Meeting

The Wise County Board of Supervisors met in a Workshop meeting on Thursday, November 7, 2002, at 6:00 in the Board of Supervisors room located in the Wise County courthouse, Wise, Va.  The following were present:

PRAYER

Nathaniel Maggard led the Board in prayer.

IN RE:  APPROVAL OF AGENDA

Chairman Stallard asked that the following items be added to next week's agenda:

IN RE:  PUBLIC EXPRESSION

John Griffith asked the Board to adopt the resolution regarding the Strawberry Mountain Water Project.

Gwen Dean, representing P.A.W.S. addressed the Board asking that they be placed on next week's agenda because they were not prepared to speak at this meeting.

 

IN RE:  PUBLIC HEARING-REZONING/DAVID H. HUBBARD

A public hearing was duly advertised for this date to receive citizens input regarding a  request from David H. Hubbard to rezone one acre of land located at 8240 Indian Creek Road from A-RR to a B-2 District for the purpose of placing a bill board sign.

There was no opposition to the proposed rezoning request.

There being no comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING-DANCE HALL LICENSE/PIT STOP FAMILY GRILL

A public hearing was duly advertised for this date to receive citizens input regarding a request from Cara Branch for a dance hall license for the Pit Stop Family Grill, Inc., (former Old Moose Lodge building) located on the Norton/Coeburn Road.

There was no one to speak for or against the dance hall license.

There being no comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING-PROPOSED ORDINANCE CREATING LOCAL ENTERPRISE ZONE DEVELOPMENT TAXATION PROGRAM

A public hearing was duly advertised for this date to receive citizens' comments regarding a proposed ordinance creating a Local Enterprise Zone Development Taxation Program for Wise County.

There being no one to speak, the public hearing was closed.

 

IN RE:  PUBLIC HEARING-PROPOSED COMMUNITY WATERWORKS MODEL ORDINANCE (CROSS CONNECTION CONTROL)

A public hearing was duly advertised for this date to receive citizens' comments regarding a proposed Community Waterworks Model Ordinance (Cross Connection Control) for Wise County.

There being no one to speak, the public hearing was closed.

 

IN RE:  PUBLIC HEARING - PROPOSED COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION TO BE SUBMITTED TO THE VA DHCD FOR THE STRAWBERRY MOUNTAIN WATER PROJECT

A public hearing was duly advertised for this date to solicit public input on the proposed Community Development Block Grant (CDBG) application to be submitted to the Virginia Department of Housing and Community Development for the Strawberry Mountain Water Project.

John Griffith, and Billy Kilgore, residents of Strawberry Mountain, informed the Board that they, as well as other residents living on Strawberry Mountain, have been hauling water for several years.  They asked the Board to support the CDBG application for the Strawberry Mountain water project.

Danny Buchanan, PSA Director, explained the mechanics of the "Self-Help" water project and the funding for such projects.  He noted that the residents of Strawberry Mountain have been consistent in pursuing this project with the intent and determination in getting the project completed.

Benny Mullins voiced his support of the water project.

There being no further comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING-PROPOSED REVISION OF THE SECONDARY ROADS SIX-YEAR IMPROVEMENT PLAN

A notice was duly advertised for this date to hold a public hearing on the proposed revision of the Secondary Roads Six-Year Improvement Plan to be held jointly by the Wise County Board of Supervisors and the Virginia Department of Transportation to receive public input and comments prior to the Six-Year Plan being updated.

Highway Resident Engineer T. G. Branson stated that this public hearing is being held in accordance of section 33.1-7 of the Code of Virginia and properly advertised.  He reviewed the proposed Six-Year Plan for 2003-04 - 2008-09 by each road name.  He noted that this past spring, budget cuts were made in the secondary construction funds; therefore, the plan was revised to reflect those cuts. At that time, in this revision, as many projects were left in the plan that could possibly be funded with the remaining funds.  After receiving the allocations for the upcoming year, the projects already on the plan were funded.  Regrettably, no new additions can be added to the plan.

Mr. Branson reviewed each project on the plan with a brief description of each.

Christy Zonka addressed the Board regarding the widening of the Powell Valley Road from the turn off to the lake up to the quarry.  She stated that since the new highway has been opened, the trucks from the quarry have ceased to a minimum.  Due to the decrease in traffic, she explained that there is no purpose in widening this road and she, as a resident of that area, opposes the project.

Mr. Branson advised that the widening of this road is for safety purposes.

IN RE:  ROADS AND HIGHWAYS

Mr. Branson gave a brief update on construction throughout the County.

Several Board members presented requests to Mr. Branson for his review with a report on his findings to be submitted at the next meeting.

 

IN RE:  CONSENT AGENDA

The following items were reviewed on the consent agenda:

  1. Set public hearing (December 5) (6:00 pm) on proposed ordinance setting deadline for filing and disposition of all applications for relief from reassessment with the Board of Equalization

  2. Set public hearing (December 5) (6:00 pm) on proposed amendment to Animal and Fowl Ordinance regarding fines for not adhering to spay/neutering requirements (requested by P.A.W.S. of Southwest Virginia, Inc)

  3. Set public hearing (December 5) (6:00 pm) on proposed amendments to the adopted FY 2002-03 budget adding all funding for the PD1 Community Services Board and implementing the proposed Cost Containment Plan

  4. Proclamation urging support for and participation in the Great American Smoke-out Day (November 21)

  5. Commissioner of Revenue Request for Refund

Budget Amendments

  1. No. 10:  Add to General Fund revenues and disperse Department of Fire Programs Grant

  2. No. 11:  Add to General Fund revenues $44,500 from various sources and disburse to several line items in the DEVELOP budget

Appropriations

Appropriate $584 for the Sheriff's Crime Prevention Special Fund and $185 in his Drug Education Fund (DARE)

 

IN RE:  CLINCH COALITION REQUEST

Detta Davis reiterated her request to the Board for its support in the preservation of our natural resources for recreation, tourism and to enhance our economy. She commented that the Forest Service has announced that they plan to cut 1400 acres on the High Knob Bark Camp area.  After presenting a petition against this clear cutting, they reduced the amount of area to be cut to 700 acres.  Since the cutting practices have not improved, the Board was asked to consider a resolution supporting the idea of a National Conservation Recreation area for the High Knob and the surrounding National Forest and private lands.

Tom Danvenport, member of the Clinch Coalition, gave the Board a brief history on the method that is used by the Forest Service in distributing the funds from the timbering.  He noted that funds are provided for improvements for work on the national recreation areas.

There was some discussion on the effect this proposed resolution would have on wood related industry coming into the area.

Jeff Salyers stated that the Tourism Authority wanted to support the endeavors of the Coalition for the work that its doing in regard to promoting tourism in Wise County.

Virginia Meador asked that someone from the Forestry Department be at the next meeting to answer questions regarding the forestry's clear cutting practices.

 

IN RE:  WISE COUNTY TOURISM AUTHORITY REQUEST/KIOSKS

Jeff Salyers stated that the Heart of Appalachia Tourism Authority has taken on the Kiosks project with the support of the Virginia Tourism Corporation and Virginia Department of Transportation.  The Authority has put forth efforts to have the seven (7) counties and the City of Norton to build a Tourism Kiosk in their county and the City of Norton.  Wise County was granted two (2) Kiosks; one at the Powell Valley overlook and one (1) at Pound near the VA/KY line.  Mr. Salyers gave the criteria that must be met before the Kiosks can be put in place, and prior to State designation. 

There was some discussion on the cost for Wise County regarding lights, upkeep, insurance, etc.

Chairman Stallard asked that cost figures for the Kiosks be brought to the Board at its next meeting.

 

IN RE:  COUNTY ADMINISTRATOR'S REPORT/PROPOSED COST CONTAINMENT PLAN

Administrator Sealover gave a power point presentation on the proposed Cost Containment Plan.

 

IN RE:  OTHER ITEMS DISCUSSED

  1. Award bid for design and construction services for new pound

  2. Authorize contract negotiations for Derby project engineering services

  3. Resolution requesting Disaster Designation and Federal Assistance for Wise County (drought and excessive heat)

  4. Appointments

  5. Fiscal Status Report (Available November 14, 2002)

  6. County Attorney's Report (None)

  7. Closed Session (November 14, 2002)

 

BOARD COMMENTS

Jeff Salyers asked the Board to consider giving some financial assistance to the Coeburn Primary School in constructing a playground.  He said the Board has helped several other schools in this same endeavor.
